Public Offer Agreement for EasyTun Services
Sole Proprietor Slonimsky Grigoriy Alexandrovich (TIN 770971796064, OGRNIP 324774600228445), hereinafter referred to as the "Service Provider", publishes in the public domain on the Internet at https://easytun.io/oferta this Public Offer Agreement (hereinafter "Agreement"), addressed to any legally capable individual (hereinafter "Customer"), for the conclusion of a service agreement (hereinafter "Contract") on the terms set forth below.
This Agreement constitutes a public offer within the meaning of Articles 435 and 437 of the Civil Code of the Russian Federation (hereinafter "RF CC"). The Contract constitutes an adhesion contract within the meaning of Article 428 of the RF CC.
1. Terms and Definitions
1.1. Agreement — this document, published at https://easytun.io/oferta, containing all material terms of the Services.
1.2. Acceptance — the Customer's full and unconditional acceptance of the terms of the Agreement by performing the actions specified in Section 3 of the Agreement (Article 438(3) of the RF CC).
1.3. Customer — a fully legally capable individual who has accepted the terms of the Agreement and entered into a Contract with the Service Provider.
1.4. Service Provider — Sole Proprietor Slonimsky Grigoriy Alexandrovich (TIN 770971796064, OGRNIP 324774600228445).
1.5. Services — services for providing a secure communication channel (VPN) for encrypting the Customer's internet traffic, delivered remotely by the Service Provider over the Internet.
1.6. Website — the Service Provider's internet resource located at https://easytun.io, including all pages of the domain.
1.7. Personal Account — the Customer's personal section on the Website, accessible after authentication and intended for managing the Subscription, viewing payment history and account settings.
1.8. Tariff — a set of service conditions (volume, duration, number of connected devices) published on the Website with the applicable price.
1.9. Subscription — the period of access to the Services paid for by the Customer in accordance with the selected Tariff.
1.10. Auto-Renewal — the automatic renewal of the Subscription by charging the Customer's bank card pursuant to a separate Agreement on Enrollment in the Recurring Payments System (https://easytun.io/recurrent-payments). Auto-Renewal is disabled by default and is activated voluntarily by the Customer.
2. General Provisions
2.1. The subject matter of this Agreement is the provision, for consideration, by the Service Provider to the Customer of a secure communication channel (VPN) for encrypting internet traffic, ensuring the confidentiality and security of data transmission over the Internet.
2.2. The EasyTun service is designed to protect the communication channel, encrypt traffic, and ensure the confidentiality of the Customer's data when using the Internet, including when connecting via public Wi-Fi networks and mobile networks. The service is not a means of circumventing restrictions on access to information established under the laws of the Russian Federation and is not intended to access informational resources whose access is restricted on the territory of the Russian Federation pursuant to Federal Law No. 149-FZ of 27.07.2006 "On Information, Information Technologies and Information Protection".
2.3. The Service Provider does not intercept, record, store or analyse the content of user traffic transmitted via the VPN connection, in accordance with Article 63 of Federal Law No. 126-FZ of 07.07.2003 "On Communications".
2.4. This Agreement applies to the territory of the Russian Federation. The applicable law is the legislation of the Russian Federation.
3. Procedure for Concluding the Contract
3.1. The Contract shall be deemed concluded from the moment the Customer performs Acceptance of the Agreement. Acceptance means the performance of all of the following actions:
- completing the registration procedure on the Website (creating an account) or logging in to the Personal Account;
- selecting a Tariff;
- paying for the selected Tariff by one of the methods available on the Website.
3.2. Making payment confirms that the Customer has fully reviewed and agrees to the terms of this Agreement, the Privacy Policy (https://easytun.io/privacy) and, upon activating Auto-Renewal, the Agreement on Enrollment in the Recurring Payments System (https://easytun.io/recurrent-payments).
3.3. The Contract is concluded in electronic form, which in accordance with Article 434(3) and Article 438(3) of the RF CC is recognised as compliance with the written form of contract. The Customer's use of their account credentials (login and password) is recognised as the equivalent of a simple electronic signature within the meaning of Article 6 of Federal Law No. 63-FZ of 06.04.2011 "On Electronic Signatures".
4. Price and Payment Procedure
4.1. The price of the Services is determined by the Tariffs published on the Website. All prices are quoted in Russian roubles. The Service Provider operates under a simplified taxation system and is not a VAT payer.
4.2. Payment for the Services is made by non-cash means using bank cards via the payment gateway of OOO NKO "YuMani" (YooKassa), operating under a licence from the Bank of Russia in accordance with Federal Law No. 161-FZ of 27.06.2011 "On the National Payment System". Payment via Telegram Stars through the Service Provider's Telegram bot is also available.
4.3. The Customer's payment obligation shall be deemed fulfilled from the moment the funds are received in the Service Provider's settlement account (confirmation from the payment gateway).
4.4. The Service Provider may unilaterally change Tariff prices. Price changes do not apply to Subscriptions paid for prior to the change — they remain effective on the terms that existed as of the date of payment.
4.5. If the Tariff price increases by more than 10%, the Service Provider shall notify Customers who have activated Auto-Renewal by email no later than 7 (seven) calendar days before the next scheduled charge date.
5. Service Delivery Procedure
5.1. The Services are activated automatically within 5 (five) minutes after the payment gateway confirms payment. The VPN connection link (configuration) is provided to the Customer in the Personal Account on the Website and/or through the Service Provider's Telegram bot.
5.2. The Service Provider ensures round-the-clock operation of the Service, except for scheduled maintenance breaks (not more than 4 hours per month). The Customer is notified of scheduled maintenance exceeding 1 hour via the Personal Account or by email at least 24 hours in advance.
5.3. Technical support is provided by email at support@easytun.xyz and via the Service Provider's Telegram bot. The response time for inquiries is no more than 24 hours on business days.
5.4. The Services shall be deemed duly rendered if, during the paid period, the Customer has not submitted a substantiated claim to the Service Provider.
6. Subscription Auto-Renewal
6.1. Subscription Auto-Renewal is disabled by default. The Customer may voluntarily activate Auto-Renewal by checking "Enable subscription auto-renewal" during payment or in the Personal Account.
6.2. The terms of Auto-Renewal are governed by a separate document — the Agreement on Enrollment in the Recurring Payments System, published at https://easytun.io/recurrent-payments. Activating Auto-Renewal constitutes the Customer's consent to the terms of that Agreement.
6.3. The Customer may disable Auto-Renewal at any time via the Personal Account (section "Subscription Management" → "Disable auto-renewal") or by submitting a request to support@easytun.xyz. Deactivation occurs no later than 24 hours from receipt of the request. The already-paid period is preserved.
6.4. The renewal price is determined by the current Tariff at the time of charge (subject to clauses 4.4 and 4.5 of this Agreement).
7. Rights and Obligations of the Parties
7.1. The Customer is entitled to:
7.1.1. Use the Services within the scope of the paid Tariff for the entire duration of the Subscription.
7.1.2. Contact the Service Provider's technical support regarding matters related to the provision of Services.
7.1.3. Withdraw from the Services at any time in the manner provided in Section 9 of this Agreement.
7.1.4. Manage the Subscription (including Auto-Renewal) through the Personal Account.
7.2. The Customer is obliged to:
7.2.1. Pay for the Services in the manner and on the terms provided in this Agreement.
7.2.2. Provide a valid email address upon registration.
7.2.3. Comply with the Service use restrictions set out in Section 10 of this Agreement.
7.2.4. Independently maintain the confidentiality of their account credentials (login, password) and VPN connection data.
7.2.5. Not use the Services for purposes contrary to the laws of the Russian Federation.
7.3. The Service Provider is entitled to:
7.3.1. Suspend or terminate the provision of Services to the Customer in the cases provided in Section 10 of this Agreement.
7.3.2. Modify Tariffs in the manner provided in clause 4.4 of this Agreement.
7.3.3. Amend the terms of this Agreement in the manner provided in Section 14 of this Agreement.
7.3.4. Send informational and service messages to the Customer by email.
7.4. The Service Provider is obliged to:
7.4.1. Provide the Services in accordance with the terms of the selected Tariff and this Agreement.
7.4.2. Provide technical support to the Customer in the manner provided in clause 5.3 of this Agreement.
7.4.3. Protect the Customer's personal data in accordance with Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" and the Privacy Policy (https://easytun.io/privacy).
7.4.4. Notify the Customer of changes to the terms of this Agreement in the manner provided in Section 14 of this Agreement.
8. Liability of the Parties
8.1. The Parties shall be liable for non-performance or improper performance of their obligations under the Contract in accordance with the laws of the Russian Federation and the terms of this Agreement.
8.2. The Service Provider shall not be liable for:
8.2.1. The speed and quality of the Customer's internet connection provided by the Customer's internet service provider. The actual VPN connection speed depends on network configuration, load, the quality of the Customer's communication channel and other factors beyond the Service Provider's control.
8.2.2. Temporary unavailability of the Service caused by the actions of third parties (hosting providers, telecommunication operators, government authorities), technical failures of equipment or communication channels not belonging to the Service Provider.
8.2.3. Restriction or blocking of access to the Service by government authorities of the Russian Federation or other jurisdictions.
8.2.4. Failures or errors of payment systems during payment or refund transactions.
8.2.5. Actions of the Customer performed using the VPN connection, including violation of applicable law, data loss, or unauthorised access to third-party resources.
8.2.6. Loss of the Customer's data, messages or files arising from the use of the Service or interruptions in its operation.
8.3. The aggregate liability of the Service Provider under the Contract is limited to the amount actually paid by the Customer for the Subscription during the 3 (three) months preceding the event giving rise to liability.
8.4. The Customer's lost profits shall not be subject to compensation.
8.5. Force Majeure. The Parties shall be released from liability for total or partial non-performance of their obligations under the Contract if such non-performance results from force majeure circumstances arising after the Contract was concluded, which the Party could not have foreseen and prevented by reasonable measures. Such circumstances include, in particular: natural disasters, military operations, acts of government authorities, material changes in legislation, failures in global communication networks. The Party invoking force majeure shall notify the other Party within 5 (five) business days from the occurrence of such circumstances.
9. Refunds
9.1. The Customer may withdraw from the Services at any time pursuant to Article 32 of the Law of the Russian Federation No. 2300-1 of 07.02.1992 "On the Protection of Consumer Rights".
9.2. Upon early withdrawal from the Services, the Customer shall receive a refund of the Subscription price proportional to the unused period, less the costs actually incurred by the Service Provider in delivering the Services up to the date of withdrawal.
9.3. To process a refund, the Customer sends a free-form application to support@easytun.xyz, specifying the email address used at registration.
9.4. The refund request review period is no more than 10 (ten) business days from the date of receipt by the Service Provider. Refunds are made by the same method used for payment, within 10 (ten) business days from the date the refund decision is made.
9.5. No refund is issued for the trial (free) period.
10. Service Use Restrictions
10.1. When using the Service, the Customer is prohibited from:
10.1.1. Using the Service for purposes contrary to the laws of the Russian Federation or the laws of the country in which the Customer is physically located.
10.1.2. Sending spam (mass unsolicited messages), phishing, port scanning, DDoS attacks and other forms of network attacks using the VPN connection.
10.1.3. Sharing individual access keys and connection links with third parties, except for close family members of the Customer (spouse, parents, children), within the device limit specified by the Tariff.
10.1.4. Using the Service for automated downloading, scraping or mass extraction of data from third-party resources if this violates the terms of use of such resources.
10.2. The fair use traffic limit is 2 (two) terabytes per 30 (thirty) calendar days. If this volume is exceeded, the Service Provider may notify the Customer and temporarily limit the connection speed. Full access blocking for exceeding the traffic limit shall not occur without prior notice to the Customer.
10.3. If violations specified in clause 10.1 are identified, the Service Provider may:
- send the Customer a written warning by email;
- suspend access to the Services until the violation is remedied;
- unilaterally terminate the Contract with a refund of the cost of the unused Subscription period less actual costs.
10.4. In the event of systematic (two or more) or gross violations of the terms of this Agreement, the Service Provider may terminate the Contract without refund.
11. Personal Data
11.1. In the course of concluding and performing the Contract, the Service Provider processes the Customer's personal data in accordance with Federal Law No. 152-FZ of 27.07.2006 "On Personal Data" and the Privacy Policy published at https://easytun.io/privacy.
11.2. By accepting this Agreement, the Customer consents to the processing of the following personal data:
- email address — for identification, authentication, and sending service notifications;
- IP address when connecting to the Service — for protecting the infrastructure against DDoS attacks, ensuring security, and monitoring the device limit (data is stored only for the duration of the Subscription);
- payment data (transaction identifier, masked card number) — transmitted to and processed by OOO NKO "YuMani" (YooKassa) in compliance with PCI DSS. The Service Provider does not store full bank card details.
11.3. The Customer may exercise their rights as a personal data subject (access, correction, deletion, withdrawal of consent) by submitting a request to dpo@easytun.xyz.
12. Term and Termination
12.1. The Contract enters into force upon Acceptance of this Agreement and remains in effect until the Parties have fully performed their obligations.
12.2. If Auto-Renewal is activated, the Contract remains in effect until Auto-Renewal is disabled and the last paid Subscription period expires.
12.3. The Customer may terminate the Contract at any time by withdrawing from the Services in the manner provided in Section 9 of this Agreement.
12.4. The Service Provider may unilaterally terminate the Contract in the cases provided in clauses 10.3 and 10.4 of this Agreement, notifying the Customer by email.
12.5. Termination of the Contract does not release the Parties from performing obligations arising before its termination (including payment, refund and personal data protection obligations).
13. Dispute Resolution
13.1. All disputes and disagreements arising from or in connection with the Contract shall be resolved by the Parties through negotiations.
13.2. Pre-trial claims procedure is mandatory. A claim is submitted in writing by email (by the Customer to support@easytun.xyz, by the Service Provider to the Customer's address specified at registration). The claim review period is 30 (thirty) calendar days from the date of receipt.
13.3. If agreement is not reached, the dispute shall be referred to a court at the place of the Service Provider's location (Moscow) in accordance with the laws of the Russian Federation, taking into account the jurisdictional rules of the Code of Civil Procedure of the Russian Federation and the Law of the Russian Federation "On the Protection of Consumer Rights".
14. Amendment of the Agreement
14.1. The Service Provider may unilaterally amend this Agreement. The amended version of the Agreement is published on the Website at https://easytun.io/oferta with the date of the latest update indicated.
14.2. Amendments take effect 10 (ten) calendar days after the new version is published on the Website, unless a later effective date is specified in the new version itself.
14.3. Continued use of the Services after the amendments take effect constitutes the Customer's consent to the new version of the Agreement. If the Customer disagrees, they may withdraw from the Services in the manner provided in Section 9 of this Agreement.
14.4. Amendments to the Agreement do not apply to obligations arising before the amendments take effect (including the terms of already-paid Subscriptions).
15. Miscellaneous
15.1. In all matters not regulated by this Agreement, the Parties shall be governed by the applicable laws of the Russian Federation.
15.2. If any provision of this Agreement is found to be invalid or unenforceable, this shall not affect the validity of its remaining provisions.
15.3. All notices and communications under the Contract shall be deemed duly delivered when sent by email to the addresses specified at registration (for the Customer) and in Section 16 of this Agreement (for the Service Provider).
