Recurring Payments Agreement
This Agreement (hereinafter "Agreement") is concluded between Sole Proprietor Slonimsky Grigoriy Alexandrovich (TIN 770971796064, OGRNIP 324774600228445), hereinafter "Service Provider", and a legally capable individual (hereinafter "Client") who has entered into the public offer for services (hereinafter "Contract") published at https://easytun.io/oferta and who has expressed an intention to use the automatic bank card debit service to pay for Services under the Contract.
This Agreement constitutes an adhesion contract within the meaning of Article 428 of the Civil Code of the Russian Federation (hereinafter "RF CC"). Activation of the recurring payment service constitutes the Client's full and unconditional acceptance of all terms of this Agreement.
1. Terms and Definitions
1.1. Client — a legally capable individual who has entered into the Contract with the Service Provider and has activated the recurring payment service.
1.2. Service Provider — Sole Proprietor Slonimsky Grigoriy Alexandrovich (TIN 770971796064, OGRNIP 324774600228445).
1.3. "Recurring Payment" Service — an automated mechanism for debiting funds from the Client's Bank Card in favour of the Service Provider for Subscription renewal payments, implemented through the Processing Centre.
1.4. Issuing Bank — the credit institution that has issued the Client's Bank Card in the Russian Federation.
1.5. Bank Card — a debit or credit card issued by the Issuing Bank in the Client's name, which is an instrument for non-cash payments in accordance with the laws of the Russian Federation. Payment for Services is available using bank cards registered in accordance with Russian Federation law (Visa, Mastercard, MIR).
1.6. Processing Centre — OOO NKO "YuMani" (YooKassa), a non-banking credit institution operating under a Bank of Russia licence in accordance with Federal Law No. 161-FZ of 27.06.2011 "On the National Payment System", providing acceptance and processing of bank card payments.
1.7. Personal Data — any information relating directly or indirectly to an identified or identifiable individual (personal data subject), in accordance with Federal Law No. 152-FZ of 27.07.2006 "On Personal Data".
1.8. Personal Account — the Client's personal section on the Website at https://easytun.io.
1.9. Subscription — the Client's paid period of access to the EasyTun VPN service in accordance with the selected Tariff.
1.10. Card Token (payment_method_id) — a unique card binding identifier assigned by the Processing Centre and used for subsequent debits without re-entering card details.
2. Subject Matter
2.1. The "Recurring Payment" Service enables the Client to automatically pay for EasyTun VPN Subscription renewals by automatically debiting funds from the Client's Bank Card through the Processing Centre.
2.2. After activation of the "Recurring Payment" Service, funds are automatically debited from the Client's Bank Card in the amount of the Subscription renewal cost at the applicable Tariff, on the dates and in the manner set out in Section 4 of this Agreement.
2.3. All settlements under this Agreement are made in Russian roubles.
2.4. No additional fee is charged for use of the "Recurring Payment" Service (activation, use, or deactivation).
3. Activation
3.1. The "Recurring Payment" Service is activated by the Client performing the following actions:
3.1.1. When paying for a Subscription on the Website, the Client checks the "Enable auto-renewal" option on the payment page.
3.1.2. The Client is redirected to the Processing Centre's (YooKassa) payment page, where they enter their Bank Card details and complete the payment.
3.1.3. After successful payment, the Processing Centre saves the Card Token (payment_method_id). The "Recurring Payment" Service is deemed activated, and the Service Provider obtains the right to automatically debit funds for Subscription renewals.
3.2. Activation is also available through the Personal Account (Subscription Management section) if the Client has previously made a payment through YooKassa and the card binding has been saved.
3.3. Activation of the "Recurring Payment" Service constitutes the Client's consent to automatic debiting and to the transfer of data necessary for payment processing to the Processing Centre.
3.4. Activation is only possible where technically feasible on the part of the Service Provider, the Processing Centre and the Issuing Bank.
4. Debit Procedure
4.1. Automatic debit is made 3 (three) calendar days before the end of the current paid Subscription period. If the first debit attempt fails, a repeat attempt is made on the day the Subscription expires.
4.2. The debit amount corresponds to the Subscription renewal cost at the applicable Tariff at the time of debit. If the Tariff price has changed since the previous payment, the debit is made at the new price. If the price increases by more than 10%, the Client is notified by email no later than 7 (seven) calendar days before the debit date (clause 4.5 of the Offer Agreement).
4.3. Repeat debit attempts following rejection of the first transaction are made in accordance with the standard algorithm of the Processing Centre (YooKassa). The number of repeat attempts is not more than 3 (three) within 3 (three) calendar days.
4.4. The actual debit of funds is carried out by the Issuing Bank upon a request from the Processing Centre.
4.5. In the event of insufficient funds in the Bank Card account or rejection of the transaction by the Issuing Bank for other reasons, the "Recurring Payment" Service is suspended. The Subscription is not renewed. The Client may renew the Subscription and auto-renewal through the Personal Account by making a manual payment.
5. Deactivation (Cancellation)
5.1. The Client may deactivate the "Recurring Payment" Service at any time by one of the following methods:
- through the Personal Account: Subscription Management section → "Disable auto-renewal";
- by sending a written request to support@easytun.xyz.
5.2. Deactivation of the "Recurring Payment" Service is carried out no later than 24 (twenty-four) hours after the Service Provider receives the request.
5.3. Deactivation of the "Recurring Payment" Service does not terminate the current paid Subscription. The Subscription remains active until the end of the paid period.
5.4. After deactivation of the "Recurring Payment" Service, the Card Token (payment_method_id) is deleted from the Service Provider's system. Re-activation will require a new card binding.
6. Rights and Obligations of the Parties
6.1. The Client is entitled to:
6.1.1. Deactivate the "Recurring Payment" Service at any time in the manner provided in Section 5.
6.1.2. Obtain information on the date and amount of the upcoming debit in the Personal Account.
6.1.3. Contact technical support for questions related to recurring payments (support@easytun.xyz).
6.2. The Client is obliged to:
6.2.1. Use only a Bank Card of which they are the cardholder. If the Client uses a Bank Card belonging to another person, the Client bears sole responsibility for any damage caused to the cardholder.
6.2.2. Ensure sufficient funds in the Bank Card account for the debit to be processed.
6.2.3. In the event of loss, blocking or replacement of the Bank Card, notify the Service Provider within 3 (three) business days in order to suspend recurring debits from the lost card.
6.2.4. Independently monitor the dates and amounts of debits.
6.3. The Service Provider is entitled to:
6.3.1. Refuse to activate the "Recurring Payment" Service for the Client without explanation.
6.3.2. Terminate the use of the "Recurring Payment" Service if the Client breaches the terms of this Agreement or the Contract.
6.3.3. Retry the debit request following rejection of the first transaction (clause 4.3 of the Agreement).
6.4. The Service Provider is obliged to:
6.4.1. Send the Client an email notification of each successful debit within 1 (one) hour of the transaction.
6.4.2. Send the Client an email notification of each failed debit attempt within 1 (one) hour of rejection.
6.4.3. Ensure the ability to deactivate the "Recurring Payment" Service through the Personal Account 24/7.
7. Card Data Storage and Security
7.1. The Service Provider does not store or process the full Bank Card number, CVV/CVC code, card expiry date or other payment credentials.
7.2. Only the Card Token (payment_method_id) assigned by the Processing Centre (YooKassa) is stored in the Service Provider's system. The token is an anonymised identifier and does not allow the Bank Card details to be recovered.
7.3. All Bank Card data is stored and processed by the Processing Centre (YooKassa) in accordance with PCI DSS Level 1 security standard.
7.4. Processing of the Client's personal data is carried out in accordance with the Privacy Policy (https://easytun.io/privacy) and Federal Law No. 152-FZ of 27.07.2006 "On Personal Data".
8. Amendment of Terms
8.1. The Service Provider may unilaterally amend this Agreement. The amended version is published on the Website at https://easytun.io/recurrent-payments with the update date indicated.
8.2. If the Client disagrees with the amendments, they may deactivate the "Recurring Payment" Service within 10 (ten) calendar days of the publication of the new version. If the Client has not deactivated the Service within that period, they are deemed to have agreed to the amendments.
8.3. Changes to Tariff prices are governed by the Offer Agreement (https://easytun.io/oferta, clauses 4.4–4.5) and do not require amendment of this Agreement.
9. Term and Termination
9.1. This Agreement enters into force upon activation of the "Recurring Payment" Service and remains in effect until deactivation by the Client or the Service Provider, or until the Contract is terminated.
9.2. Upon termination of the Contract, this Agreement terminates automatically.
9.3. The Service Provider may unilaterally terminate this Agreement in the event of the Client's breach of the terms of this Agreement or the Contract, notifying the Client by email at least 5 (five) calendar days in advance.
10. Liability of the Parties
10.1. The Service Provider shall not be liable for:
- rejection of transactions by the Issuing Bank or the Processing Centre for reasons beyond the Service Provider's control;
- temporary unavailability of the "Recurring Payment" Service due to technical reasons beyond the Service Provider's control;
- consequences of the Client's use of a Bank Card of which they are not the cardholder.
10.2. All matters relating to rejection of Bank Card transactions shall be resolved independently by the Client with the Issuing Bank.
10.3. The Parties are released from liability for non-performance of obligations due to force majeure circumstances.
11. Dispute Resolution
11.1. Disputes arising from this Agreement shall be resolved by the Parties through negotiations.
11.2. Pre-trial claims procedure is mandatory. Claims are submitted by email (by the Client to support@easytun.xyz, by the Service Provider to the Client's address). The review period is 10 (ten) business days.
11.3. If agreement is not reached, the dispute shall be referred to a court at the place of the Service Provider's location (Moscow) in accordance with the laws of the Russian Federation, taking into account jurisdiction rules provided by the Code of Civil Procedure of the Russian Federation and the Law of the Russian Federation "On Consumer Protection".
